By accepting this Agreement, the BUYER acknowledges and declares in advance that upon confirming the relevant order, they will be obliged to pay the order amount and any additional charges such as shipping fees and taxes, and that they have been informed about this matter.
2. DEFINITIONS
For the implementation and interpretation of this Agreement, the terms listed below shall have the meanings indicated next to them:
MINISTER: The Minister of Customs and Trade.
MINISTRY: The Ministry of Customs and Trade.
LAW: Law No. 6502 on Consumer Protection.
REGULATION: Distance Sales Regulation (Official Gazette: 27.11.2014/29188).
SERVICE: Any consumer transaction, other than supply of goods, performed or committed to be performed in return for a fee or benefit.
SELLER: A company offering goods to consumers within the scope of its commercial or professional activities or acting on behalf of or for the account of the supplier.
BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes.
SITE: The SELLER’s website store.batioptik.com.tr / batioptik.com.tr.
ORDERING PARTY: A natural or legal person who requests goods or services through the SELLER’s website.
PARTIES: The SELLER and the BUYER.
AGREEMENT: This contract executed between the SELLER and the BUYER.
GOODS: Movable property and intangible items such as software, audio, video prepared for use in electronic form.
3. SUBJECT
This Agreement regulates the rights and obligations of the parties pursuant to Law No. 6502 and the Distance Sales Regulation regarding the sale and delivery of the product ordered electronically by the BUYER on the SELLER’s website, with characteristics and sales price specified below. The prices listed and announced on the site are sales prices. The announced prices and commitments remain valid until updated or changed. Time-limited prices remain valid until the end of the specified period.

7. PRODUCTS SUBJECT TO THE AGREEMENT
7.1. The basic characteristics of the goods/services (type, quantity, brand/model, color, number) are published on the SELLER’s website. If a campaign is organized, the characteristics of the relevant product can be reviewed during the campaign period.
7.2. The listed and published prices on the site are sales prices and remain valid until updated or changed.
7.3. The total sales price including all taxes is shown as: Product Description, Quantity, Unit Price, Subtotal (Including VAT), Shipping Fee, Total, Payment Method and Plan, Delivery Address, Recipient, Billing Address, Order Date, Delivery Date, Delivery Method.
7.4. Shipping costs shall be borne by the BUYER.

Invoice delivery: The invoice will be delivered to the billing address during order delivery.
9. GENERAL PROVISIONS
9.1. The BUYER acknowledges and confirms electronically that they have read and understood all preliminary information about the product.
9.2. Delivery shall be completed within 30 days unless the BUYER’s location requires additional time.
9.3. The SELLER undertakes to deliver the product completely, free of defects, and in compliance with all legal requirements.
9.4. A different product of equal quality and price may be supplied with the BUYER’s explicit approval.
9.5. If fulfillment becomes impossible, the SELLER shall notify the BUYER within 3 days and refund the payment within 14 days.
9.6. If payment is not received or cancelled, the SELLER is not obligated to deliver.
9.7. If the credit card is unlawfully used after delivery, the BUYER must return the product within 3 days.
9.8. In case of force majeure, the BUYER may request cancellation, replacement, or postponement.
9.9. The SELLER may contact the BUYER using the information provided.
9.10. The BUYER must inspect the product before receiving it from the courier.
9.11. Identification or documentation may be requested for security reasons.
9.12. The BUYER guarantees accuracy of personal information provided.
9.13. The BUYER must comply with legal regulations while using the website.
9.14. The BUYER may not use the website unlawfully or harmfully.
9.15. Third-party links do not indicate any guarantee or endorsement.
9.16. The BUYER is responsible for all violations and resulting legal consequences.
10. RIGHT OF WITHDRAWAL
10.1. The BUYER may exercise the right of withdrawal within 14 days from delivery without justification or penalty.
10.2. To exercise this right, written notice must be given and the product, invoice, return form, packaging, and accessories must be returned. The SELLER must refund within 10 days and collect the goods within 20 days. The BUYER is responsible for damages caused by misuse. Discounts may be cancelled if campaign conditions are not met.
11. PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL
Products prepared per the BUYER’s request or personal needs, products unsuitable for return, personal hygiene items, opened cosmetics, underwear, swimsuits, perishable goods, digital content delivered instantly, software, CDs, DVDs, stationery consumables, and similar items cannot be returned once opened or used. For cosmetics, personal care products, underwear, swimsuits, books, software, DVDs, CDs, and stationery consumables, packaging must remain unopened.
12. DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on credit card payments, they accept liability for interest and legal proceedings conducted by the bank. The BUYER must compensate the SELLER for any damages caused by delayed payments.
13. COMPETENT COURT
In disputes arising from this Agreement, applications may be made to the consumer arbitration committees or consumer courts within the monetary limits defined by law. This Agreement is made for commercial purposes.
14. EFFECTIVENESS
When the BUYER completes payment for the order placed on the Site, they are deemed to have accepted all terms of this Agreement. The SELLER must ensure that the BUYER confirms this Agreement electronically before order completion.
